These Terms of Service ("Terms") govern your access to and use of DeadClick ("Service"), operated by McCullough Data Intelligence ("Company," "we," "us"). By using the Service, you agree to be bound by these Terms.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent. By using DeadClick, you confirm that you meet these requirements.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@deadclick.io if you suspect unauthorized access.
You may not share account credentials with third parties or use the Service to monitor websites you do not own or have explicit authorization to track.

You are the data controller for behavioral data collected from your end users. DeadClick acts as a data processor on your behalf. You are responsible for obtaining appropriate consent from your end users in jurisdictions where required, and for maintaining a compliant privacy policy on your site.
Our collection and use of your information is governed by our Privacy Policy.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in these Terms. We reserve the right to change pricing with 30 days' notice to existing subscribers.
If payment fails, your account will be downgraded to the Starter plan at the end of your billing period. Data collected during your paid plan will be retained for 30 days after downgrade before deletion.
The Service and its underlying technology, algorithms, and design are the exclusive property of McCullough Data Intelligence. Your use of the Service does not grant you any intellectual property rights in the Service or its content.
You retain ownership of all data you generate and the insights derived from it. You grant us a limited license to process your data for the purpose of providing the Service.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, data, or goodwill — arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the claim.
Either party may terminate the agreement at any time. You may cancel your account from the dashboard settings. We may terminate or suspend your account for material breach of these Terms, with or without notice. Upon termination, your data will be deleted within 30 days.
We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Wyoming.
